Abstract

This research article explores the profound and multifaceted influence of Islamic teachings on the evolution and structure of modern international law. While contemporary global legal frameworks are often viewed through a Western-centric lens, this study contends that the foundational principles of Siyar (Islamic International Law) have historically contributed to, and pre-empted, many core tenets of modern humanitarian and diplomatic conduct.

The analysis delves into several critical dimensions, including the Islamic doctrine of jus in bello (laws of war), which emphasizes the protection of non-combatants, environmental preservation during conflicts, and the ethical treatment of prisoners of war—principles that align closely with the Geneva Conventions. Furthermore, the paper examines the Islamic emphasis on the sanctity of treaties (Ahd), the concept of global justice, and the egalitarian framework of human rights that challenges the conventional Westphalian sovereignty model.

By synthesizing classical Islamic legal texts with modern international legal instruments, this article demonstrates that Islamic jurisprudence offers a sophisticated, moral, and universalistic approach to global governance. The findings suggest that integrating Islamic legal ethics can provide a more inclusive and pluralistic foundation for addressing 21st-century global challenges, fostering a synthesis between divine justice and secular legal frameworks.
