This research paper explores the Qur’anic and jurisprudential discussions on divorce (ṭalāq) and delegation of divorce (tafwīḍ al-ṭalāq) in Tafsīr al-Maẓharī, authored by Qāḍī Thānā’ullāh Panipati. The study aims to highlight the interpretive methodology employed by the exegete in explaining the verses related to marital dissolution and the legal authority granted to women in certain contexts through the delegation of divorce. By analyzing relevant Qur’anic verses, juristic opinions, and the exegete’s reconciliatory approach between textual and contextual meanings, the research sheds light on how Tafsīr al-Maẓharī integrates classical Islamic jurisprudence with ethical considerations. The paper also compares the commentary’s stance with that of other traditional tafsīr works to identify its distinctive contribution to the understanding of Islamic family law.
